EMPLOYMENT & LABOUR LAW

Work Safe BC

Workers Compensation

The team of employment lawyers at Kane Shannon Weiler LLP understand that matters relating to WorkSafeBC claims can be stressful and overwhelming. We work alongside our clients with the goal of making the process as efficient as possible while achieving the best possible outcome.

WorkSafeBC for Individuals

Workplace injuries can have serious consequences, and if your claim is denied or contested by your employer, the appeals process can be long and arduous, especially when your financial wellbeing relies on the outcome. Having an experienced guide who is intimately familiar with claims and appeals process can help you resolve your claim.

At KSW Lawyers, we assist our clients in navigating their WorkSafeBC claims by helping them get fair compensation, appropriate treatment and re-training if needed. Our team has won numerous reviews, appeals, and judicial reviews for our clients throughout the last 10 years.

WorkSafeBC manages the procedures and protocols associated with the benefits that are paid out to workers under the Workers Compensation Act. These benefits include:

=
Temporary wage loss coverage
=
Vocational rehabilitation
=
Health care treatments
=
Permanent disability pensions
When an employee gets injured at their workplace, both the employer and employee have an obligation to report the incident to WorkSafeBC. If the employee submits a claim for compensation, WorkSafeBC begins the process of assessing the claim to determine if, and how, they will be compensated. The employer may object to the claim. If either the employer or the worker disagrees with WorkSafeBC’s decision, the decision may be appealed to the Review Division, and then the Workers Compensation Appeal Tribunal.

At Kane Shannon Weiler LLP, our employment lawyers have extensive experience handling all manner of WorkSafeBC cases. Appealing a decision is a time-sensitive and complicated process and requires an intimate familiarity with the rules, policies, and assessment programs.

Each WorkSafeBC decision appeal case is different and we recognize the importance of tailoring our approach to reflect this.

We also regularly advise and assist clients with respect to policy development and industry-specific regulatory obligations.
